Pero una de las m\u00e1s comunes es la relacionada con los contratos. M\u00e1s concretamente, cuando una de las partes incumple un contrato. Un contrato establece obligaciones entre dos o m\u00e1s partes, y cada una de ellas es responsable de cumplir dichas obligaciones. Si una de las partes no cumple con su parte del acuerdo, se considera un incumplimiento de contrato.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Dependiendo de los t\u00e9rminos exactos de ese contrato, puede producirse un incumplimiento cuando:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>La parte no cumple con un plazo espec\u00edfico;<\/li><li>La parte no act\u00faa de conformidad con las directrices que se enumeran en los t\u00e9rminos del acuerdo.;<\/li><li>El partido no hace nada.<\/li><\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">\u00bfQu\u00e9 sucede despu\u00e9s de incumplir un contrato?<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Si se incumple un contrato, una o varias partes pueden hacer cumplir los t\u00e9rminos de dicho contrato o intentar recuperar cualquier perjuicio financiero causado por el incumplimiento. En primer lugar, las partes deben discutir el incumplimiento entre ellas e intentar resolver el problema antes de tomar medidas legales adicionales (lea sobre el arbitraje y la mediaci\u00f3n contractual). Sin embargo, si no se llega a una soluci\u00f3n, puede ser necesario presentar una demanda para hacer cumplir los t\u00e9rminos del acuerdo y solicitar una indemnizaci\u00f3n por el incumplimiento.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">\u00bfSe puede indemnizar a una parte por las p\u00e9rdidas sufridas?<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Cuando una parte incumple un contrato, la parte afectada puede recibir una compensaci\u00f3n monetaria por las p\u00e9rdidas ocasionadas por dicho incumplimiento. Para ello, la parte afectada deber\u00e1 presentar una demanda ante un tribunal civil contra la parte culpable. Deber\u00e1 demostrar las p\u00e9rdidas ocasionadas por el incumplimiento del contrato y, a continuaci\u00f3n, podr\u00e1 solicitar una indemnizaci\u00f3n por da\u00f1os y perjuicios, que puede ascender hasta tres veces el importe de sus p\u00e9rdidas.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Algunas p\u00e9rdidas comunes que se producen con el incumplimiento de un contrato incluyen, entre otras:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>P\u00e9rdida de clientes<\/li><li>P\u00e9rdida de negocio<\/li><li>P\u00e9rdida de productos o productividad<\/li><\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">En otras ocasiones, una empresa puede reclamar da\u00f1os y perjuicios por la situaci\u00f3n en la que se ha visto envuelta debido al incumplimiento.
