Interferencia il\u00edcita<\/strong> Puede parecer un poco gracioso, pero para los empresarios y las partes de un contrato no es motivo de risa. Interferencia il\u00edcita<\/strong><\/a> ocurre cuando un tercero en una relaci\u00f3n comercial o contrato interrumpe intencionalmente dicha relaci\u00f3n o contrato.<\/p>\n

Esto puede adoptar muchas formas diferentes: cuando un empleador demanda a un ex empleado para hacer cumplir un acuerdo de no competencia, cuando los vecinos colocan carteles falsos de venta para frustrar la subasta del departamento de un vecino, o cuando una persona publica intencionadamente informaci\u00f3n falsa sobre un negocio para ahuyentar a los clientes. En general, para demostrar interferencia il\u00edcita<\/strong>, el demandante debe demostrar que (1) exist\u00eda una relaci\u00f3n comercial o incluso solo la posibilidad de una relaci\u00f3n (ventajosa o contractual) con otra parte; (2) el demandado conoc\u00eda dicha relaci\u00f3n; (3) el demandado interfiri\u00f3 de manera intencionada e injusta en la relaci\u00f3n comercial o la interrumpi\u00f3 de cualquier otra forma; y (4) dicha interrupci\u00f3n provoc\u00f3 da\u00f1os y perjuicios. Para ganar el caso, el demandante debe demostrar que los da\u00f1os y perjuicios fueron consecuencia directa de las acciones del demandado.<\/p>\n\n\n\n

Para que haya interferencia, debe existir una relaci\u00f3n. La ley de Florida reconoce dos tipos de relaciones que pueden ser objeto de interferencia il\u00edcita: las relaciones comerciales contractuales y las relaciones comerciales ventajosas.
