{"id":25411,"date":"2019-10-01T13:00:34","date_gmt":"2019-10-01T13:00:34","guid":{"rendered":"https:\/\/thecampbelllawgroup.com\/?p=25411"},"modified":"2025-10-15T13:45:14","modified_gmt":"2025-10-15T17:45:14","slug":"nueva-ley-de-normas-laborales-justas-flsa-umbrales-salariales-minimos-para-empleados-exentos-y-cambios-en-las-exenciones-por-horas-extras","status":"publish","type":"blog","link":"https:\/\/tclgfirm.com\/es\/blog\/new-fair-labor-standard-act-flsa-minimum-salary-thresholds-for-exempted-employees-and-changes-to-the-overtime-exemptions\/","title":{"rendered":"Nuevos umbrales salariales m\u00ednimos de la Ley de Normas Laborales Justas (FLSA) para los empleados exentos y cambios en las exenciones de las horas extraordinarias."},"content":{"rendered":"<h1>La FLSA<\/h1>\n<p><span style=\"font-weight: 400;\">El 24 de septiembre de 2019, el Departamento de Trabajo de los Estados Unidos (\u201c<strong><a href=\"https:\/\/www.dol.gov\/\" target=\"_blank\" rel=\"noopener noreferrer\">DOL<\/a><\/strong>\u201d) anunci\u00f3 un cambio definitivo en la normativa relativa al salario m\u00ednimo para los empleados exentos, que entrar\u00e1 en vigor a partir del <\/span><span style=\"font-weight: 400;\">1 de enero de 2020.<\/span><span style=\"font-weight: 400;\"> \u00a0 La nueva norma aumenta el umbral salarial m\u00ednimo para los empleados ejecutivos, administrativos y profesionales que est\u00e1n exentos de los requisitos de salario m\u00ednimo y pago de horas extras de la Ley de Normas Laborales Justas.\u00a0\u00a0<\/span><\/p>\n<p><!--more--><\/p>\n<p><span style=\"font-weight: 400;\">La nueva norma afectar\u00e1 a m\u00e1s de un mill\u00f3n de empleados exentos al aumentar el umbral salarial m\u00ednimo (tambi\u00e9n conocido como \u201cnivel salarial est\u00e1ndar\u201d) establecido en 2004 de $455 por semana (salario anualizado de $23,660) a $684 por semana (salario anualizado de $35,568). Este cambio en la norma definitiva tambi\u00e9n significa que los empleados que ganan menos de $35,568 al a\u00f1o ahora tienen derecho a cobrar horas extras seg\u00fan la norma definitiva del Departamento de Trabajo. La nueva norma no modifica el requisito de la prueba de funciones, solo los umbrales salariales m\u00ednimos.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-1847\" src=\"https:\/\/tclgfirm.com\/wp-content\/uploads\/2023\/04\/New-Minimum-Salary-Thresholds-1.jpg\" alt=\"Nuevos umbrales salariales m\u00ednimos\" width=\"700\" height=\"450\" \/>La nueva norma tambi\u00e9n modifica el requisito de remuneraci\u00f3n anual total para los \u201cempleados con alta remuneraci\u00f3n\u201d de $100 000 al a\u00f1o a $107 432 al a\u00f1o (Nota: <\/span><span style=\"font-weight: 400;\">Se debe seguir pagando como salario m\u00ednimo $684 por semana o su equivalente.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Los empleadores tambi\u00e9n pueden utilizar hasta el diez por ciento (10%) de las bonificaciones no discrecionales y los pagos de incentivos (incluidas las comisiones), siempre que se paguen al menos una vez al a\u00f1o, para cumplir el umbral salarial est\u00e1ndar.\u00a0\u00a0\u00a0\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Por \u00faltimo, la norma
