Las normas y reglamentos establecidos por la FLSA son aplicados por la Divisi\u00f3n de Salarios y Horas del Departamento de Trabajo. Tienen la autoridad para investigar las pol\u00edticas y procedimientos de un empleador y realizar entrevistas a los empleados con el fin de determinar el cumplimiento por parte del empleador de las normas federales de empleo y trabajo.<\/p>\n\n\n\n<p><!--more--><\/p>\n\n\n\n<p>Las infracciones de la FLSA pueden acarrear consecuencias civiles y penales para el empleador. La discriminaci\u00f3n laboral o las infracciones de las disposiciones sobre trabajo infantil pueden ser objeto de acciones penales e incluir multas de hasta $10,000. Los empleadores que infrinjan de forma deliberada o repetida los requisitos relativos al salario m\u00ednimo o al pago de horas extras estar\u00e1n sujetos a una multa civil de hasta $1,000 por cada infracci\u00f3n.\u00a0<\/p>\n\n\n\n<p>Para que un empleador garantice el cumplimiento adecuado y evite problemas, <strong>Se debe realizar internamente una auditor\u00eda peri\u00f3dica de cumplimiento de la FLSA.<\/strong>. A continuaci\u00f3n se incluye una lista de verificaci\u00f3n de los registros que deben revisarse cuidadosamente durante dichas auditor\u00edas:<\/p>\n\n\n\n<p>Para cada empleado no exento, adem\u00e1s de la informaci\u00f3n personal y biogr\u00e1fica que debe registrarse peri\u00f3dicamente en el contexto laboral, deben llevarse un seguimiento peri\u00f3dico de los siguientes registros de n\u00f3mina:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Tarjetas de control horario;\n<ul>\n<li>Tarjetas de trabajo a destajo;<\/li>\n<\/ul>\n<ul>\n<li>Hora y d\u00eda de la semana en que comienza la semana laboral del empleado;<\/li>\n<\/ul>\n<ul>\n<li>Tarifa salarial por hora regular;<\/li>\n<\/ul>\n<ul>\n<li>Horas trabajadas cada d\u00eda y total de horas trabajadas cada semana;<\/li>\n<\/ul>\n<ul>\n<li>Salarios diarios y semanales regulares;<\/li>\n<\/ul>\n<ul>\n<li>Salarios por horas extras semanales;<\/li>\n<\/ul>\n<ul>\n<li>Total de salarios pagados en cada periodo de pago;<\/li>\n<\/ul>\n<ul>\n<li>Fechas de los pagos y los periodos de pago cubiertos por el pago;<\/li>\n<\/ul>\n<ul>\n<li>Deducciones de los salarios; y<\/li>\n<\/ul>\n<ul>\n<li>Cualquier complemento salarial.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<p>Para cada empleado exento, adem\u00e1s de la informaci\u00f3n personal y biogr\u00e1fica descrita anteriormente, se debe llevar un registro peri\u00f3dico de la siguiente informaci\u00f3n:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>\u00a0Confirmaci\u00f3n de que la clasificaci\u00f3n de exenci\u00f3n es adecuada\n<ul>\n<li>Verifique que las funciones laborales del empleado se ajusten a los puestos establecidos por la FLSA como aptos para la exenci\u00f3n.\n<ul>\n<li>Aseg\u00farate de que las descripciones de los puestos de trabajo est\u00e9n actualizadas.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<ul>\n<li>\u00a0Un empleado asalariado recibe un salario m\u00ednimo de $684,00 por semana.\n<ul>\n<li>Lleve un registro del total de salarios pagados en cada periodo de pago; y<\/li>\n<\/ul>\n<ul>\n<li>La fecha de pago y el per\u00edodo de pago cubierto por el pago.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<ul>\n<li>Aseg\u00farese de que las deducciones salariales sean adecuadas y est\u00e9n permitidas por la FLSA.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<p>La conservaci\u00f3n de los registros que reflejan la informaci\u00f3n anterior es fundamental para que los empleadores se protejan en caso de que surja una disputa.
