{"id":25474,"date":"2021-07-26T14:56:50","date_gmt":"2021-07-26T14:56:50","guid":{"rendered":"https:\/\/thecampbelllawgroup.com\/?p=25474"},"modified":"2025-09-25T16:13:54","modified_gmt":"2025-09-25T20:13:54","slug":"mandato-aca","status":"publish","type":"blog","link":"https:\/\/tclgfirm.com\/es\/blog\/aca-mandate\/","title":{"rendered":"Los empresarios deben cumplir el mandato de la ACA"},"content":{"rendered":"<p>En una reciente decisi\u00f3n de la Suprema Corte de Justicia de los Estados Unidos, <em>California y otros contra Texas y otros.<\/em> decidido el 17 de junio de 2021, la Suprema Corte rechaz\u00f3 la impugnaci\u00f3n presentada por Texas y otros estados contra la Ley de Protecci\u00f3n al Paciente y <strong>Mandato individual de la Ley de Cuidado de Salud Asequible (ACA)<\/strong>, basada en la reducci\u00f3n a cero de la multa por incumplimiento del mandato individual, que entr\u00f3 en vigor en 2019.<\/p>\n\n\n\n<p><!--more--><\/p>\n\n\n\n<p>En este caso, se solicit\u00f3 al Tribunal Supremo que decidiera si la reducci\u00f3n de la multa a cero hac\u00eda inconstitucional la disposici\u00f3n sobre cobertura m\u00ednima de la ACA y, en tal caso, si el resto de la ACA pod\u00eda seguir aplic\u00e1ndose sin dicha disposici\u00f3n.\u00a0<\/p>\n\n\n\n<p>Antes de considerar los m\u00e9ritos de las reclamaciones de Texas y los dem\u00e1s estados, la Suprema Corte tuvo que considerar si los demandantes ten\u00edan legitimaci\u00f3n para impugnar la ACA. La Suprema Corte sostuvo que ninguno de los estados ten\u00eda legitimaci\u00f3n para demandar por este asunto, ya que no pudieron demostrar que el da\u00f1o que sufrir\u00edan o que supuestamente ya hab\u00edan sufrido fuera \u2019razonablemente atribuible' a la conducta ilegal que denunciaban.\u00a0<\/p>\n\n\n\n<p><strong>Esta es la tercera vez que la Suprema Corte de Justicia de la Naci\u00f3n confirma la ACA.<\/strong>. Esta resoluci\u00f3n confirma que los empleadores deben seguir garantizando el cumplimiento de todos los componentes de la ACA y ser conscientes de su responsabilidad compartida y de sus obligaciones de informaci\u00f3n.<\/p>\n\n\n\n<p>Los empleadores con cincuenta o m\u00e1s empleados a tiempo completo est\u00e1n sujetos a las regulaciones de la ACA. Estos empleadores deben seguir presentando los formularios 1095-C y 1094-C cada a\u00f1o y ofrecer un seguro m\u00e9dico colectivo al menos al 95% de sus empleados que cumplan los requisitos, o pagar una multa.<\/p>\n\n\n\n<p>Los empleadores tambi\u00e9n deben mantener planes de salud dise\u00f1ados para proporcionar los procedimientos de reclamaci\u00f3n y las prestaciones obligatorias exigidas por la ACA, como la Ley de Paridad en la Salud Mental y Equidad en las Adicciones, los nuevos requisitos de divulgaci\u00f3n tras la promulgaci\u00f3n de la Ley de Asignaciones Consolidadas de 2021 y los dem\u00e1s procedimientos y requisitos de cobertura adicionales exigidos por la ley.<\/p>\n\n\n\n<p><strong>Es importante que los empleadores inviertan recursos para mantener el cumplimiento de la ACA y estar preparados para las auditor\u00edas.<\/strong> Deben asegurarse de que sus empleados est\u00e9n correctamente clasificados como empleados a tiempo completo de conformidad con la ACA.
